Flami terms of use

1. About the platform

Flami provides tools to create and process images, video, audio, and text. Users define the task, choose source materials and parameters, select results, and refine them if necessary.

The platform operator is individual entrepreneur Igor Evgenyevich Litvintsev, INN 781394158508, OGRNIP 326784700142011. Region of registration: St. Petersburg. Support address: support@flami.pro.

These terms describe the use of results, content restrictions, and moderator decisions. Personal data processing is described in the Privacy policy, and payment, subscription, and refund terms are set out in the Public offer.

2. Commercial use of results

Commercial use of results created with Flami is permitted. Users may publish them, use them in advertising and product listings, incorporate them into client projects, sell them, and otherwise lawfully use them in their activities.

No separate permission from Flami or additional royalties to the platform are required for such use. This applies to use of the resulting material and does not remove the obligation to pay for the generation services themselves under the selected plan.

Users must comply with the law and the rights of others. Flami's permission for commercial use does not grant rights to other people's source materials, trademarks, images of people, or other objects whose use requires a separate lawful basis.

3. Rights to created materials

Flami does not claim authorship, co-authorship, or exclusive rights to results created by users with the platform's tools. Using the service does not in itself transfer to the platform the user's exclusive rights to their materials or creative contribution to the result.

The platform provides technical tools for human use. If a result meets the conditions for copyright protection, authorship is determined by a person's individual creative contribution in accordance with the law. An AI model's execution of a prompt does not in itself guarantee that copyright will arise in any resulting material.

Third-party rights remain in effect. Before publishing or selling, users verify that use of the source materials and result does not infringe the rights of other authors and rights holders, rights to a person's image, privacy, or other legally protected interests.

4. Prohibited content and use

Flami and generation results must not be used in a manner that violates the laws of the Russian Federation. This rule applies to source materials, prompts, generated results, and their subsequent use.

Creating, uploading, or distributing materials is prohibited where such actions are prohibited by law, including using results for fraud, infringement of copyright or other protected rights, unlawful disclosure of personal data, sexual exploitation of minors, or prohibited incitement to violence, terrorism, or extremist activity.

The examples are not exhaustive: the absence of a particular type of violation from these terms does not make it permissible. Users are responsible for the lawfulness of materials they upload and the manner in which they use the resulting material.

5. Moderator actions

Platform moderators may delete content that violates the laws of the Russian Federation and block users responsible for such violations.

In the event of a violation of these terms, the platform may stop providing services and terminate the contract with the user in the cases and manner provided by law and the contract. These provisions do not remove the user's statutory rights.

Restrictions of a particular model may also cause a task to be refused. A technical refusal by a generator and a moderator's decision to block an account are separate actions.

6. How to appeal a decision

Content deletion or blocking can be appealed at support@flami.pro. Use "Appeal against a moderator decision" as the email subject.

Provide your account email or identifier, information about the disputed generation or deleted material, the reason for the restriction if known, and explain what you disagree with. If you have permission from the rights holder or other documents relevant to the dispute, you may attach them to your request.

Support will consider your arguments and send the review outcome to the specified address. Submitting a request does not in itself lift the existing restriction; a mistaken decision must be reconsidered based on the review.

7. Processing your materials to perform a task

By uploading materials and running a tool, users authorize Flami to perform the technical actions necessary for the selected task: record and store files, reproduce them in equipment memory, convert their format, transfer them to the selected processor, and provide the result to the user or members of their workspace within the access rights granted.

To the extent that these actions require permission from the rights holder, the user grants Flami a simple, nonexclusive, royalty-free permission solely for the listed uses and solely to provide the requested functions. It remains in effect during task execution and storage of materials on the user's instructions, including technical deletion of copies. Processing may take place in Russia and in the country of the selected tool's external service provider. The transfer of personal data is governed separately by the policy and the law.

Exclusive rights are not transferred to Flami. This permission does not entitle the platform to use your materials in advertising, publish them independently, or train its own models on them. An independent purpose of use requires a separate basis. Users must have rights to the source materials; this permission does not replace the consent of people depicted or other necessary grounds for processing personal data.

8. Characteristics of AI results

Results depend on the selected model, source materials, and parameters. They may contain errors, inaccuracies, visual and audio artifacts, or information that is untrue. Similar prompts from different users may produce similar results: the uniqueness of each result is not guaranteed.

Before publishing, using commercially, or making decisions, users review the content and edit the result if necessary. Generation does not replace fact-checking or professional advice in areas where an error could cause harm.

These characteristics do not release Flami from liability for its own violations or remove the right to have defects remedied or receive a refund in the cases provided by law and the public offer. A task processing error and a subjective failure of the result to meet artistic expectations are assessed in light of the circumstances of the specific task.

9. Account and workspace security

Users keep passwords, sign-in codes, and API keys confidential, check the website address before authenticating, and do not share access secrets with unauthorized persons. If compromise is suspected, change the available sign-in credentials, revoke compromised keys, and notify support at support@flami.pro.

For collaboration, use the invitations, roles, and workspace permissions provided by the platform. Members gain access to materials and operations within their authority; grant only the access needed and revoke it when collaboration ends. A member's actions may consume the workspace's shared balance.

Users provide accurate information necessary for the provision of services. If entering into a contract or using materials requires the consent of a legal representative or another permission, it must be obtained in accordance with the law. Liability for disputed actions is determined in light of the actual circumstances; use of an account does not in itself rule out investigation of a report that it was hacked.
